Applies to all services provided by Expresso Company
1. Our Services
Expresso Company provides comprehensive marketing and outsourcing services, including but not limited to: digital marketing, social media management, paid media, website development, branding, content creation, video editing, customer support, cold calling, lead generation, virtual assistants, customer service, and live chat support. Specific deliverables and timelines are detailed in the applicable client agreement, scope of work, or invoice.
2. Payment & Billing
Expresso Company offers two primary engagement models:
- Contract-Based Engagements: Governed by mutually signed agreements specifying terms, deliverables, and payment schedules.
- Pay-As-You-Go Services: Charged per project, hour, on a monthly basis, or under other periodic billing structures.
Standard payment terms are Net 7 unless otherwise specified. Delays in payment may result in service suspension or termination.
3. Refund Policy
Due to the custom nature of services provided, refunds are not offered except in cases of substantiated non-delivery of agreed-upon services by Expresso Company. Clients are encouraged to raise concerns promptly to allow for resolution.
4. Client Responsibilities
Clients are expected to actively participate in their projects by providing timely feedback, approvals, and necessary materials. Failure to meet these responsibilities may affect project timelines, quality of output, and results.
5. Use of Personnel and VA Disclaimer
Clients work directly with Expresso Company personnel assigned to their projects. This may include virtual assistants, cold callers, customer service agents, marketers, and social media managers.
Expresso Company does not supervise daily interactions or tasks between the client and these individuals. As such:
- Clients are solely responsible for the tasks and directives given to assigned personnel.
- Expresso Company assumes no liability for the actions or outcomes resulting from client-directed tasks unless such actions fall under prohibited conduct outlined below.
To uphold legal and ethical standards, all personnel are required to report the following to Expresso Company management. Involvement in any of these activities will result in immediate termination of services:
Prohibited Activities
- Human Trafficking
Coercion or forced labor, including modern slavery, child trafficking, or forced marriage. - Child Pornography
Any involvement with explicit materials involving minors. - Genocide
Actions intended to eliminate, in whole or in part, any national, ethnic, racial, or religious group. - War Crimes
Serious breaches of international humanitarian law, including attacks on civilians and mistreatment of prisoners. - Crimes Against Humanity
Widespread or systematic violations such as torture, mass murder, or deportation. - Terrorism
Acts of violence intended to coerce or intimidate for political, ideological, or religious purposes. - Torture
Infliction of severe physical or psychological pain for punishment or coercion. - Slavery and Slave-like Practices
Including debt bondage, involuntary servitude, and forced labor. - Sexual Exploitation of Children
Activities such as grooming, trafficking, or abuse, both online and offline. - Organ Trafficking
Unlawful procurement and sale of human organs.
Outside of these outlined offenses, Expresso Company disclaims all liability for actions, communications, or deliverables directed or approved by the client.
6. Limitation of Liability
Expresso Company does not warrant specific business outcomes. We are not responsible for lost revenue, reputational damage, regulatory actions, or other consequences resulting from client-approved strategies, content, or campaigns.
7. Termination
Services may be terminated by either party with written notice, subject to the termination clauses within the governing service agreement. All outstanding payments are due upon termination.
8. Governing Law
These Terms & Conditions shall be governed by and interpreted under the laws of the State of Florida, United States of America, and the Republic of Nicaragua. Any disputes arising under these Terms & Conditions shall be resolved exclusively in the competent courts located in Managua, Nicaragua, where Expresso Company maintains its principal place of business.
